In 1995 the band signed with Roadrunner Records. Their debut album was produced by Eli Ball but didn't get released until a year later in 1996 because of the legal problems of the band name Penalty. They changed their name to Floodgate and the album was called Penalty.

Not to be confused with death metal band Penalty from California.
